The time for the appointment of the agents depends on the method of instituting the proceedings (see chapter 19, § III.293). In a case instituted by the filing of an application, there is a difference between what is required of the applicant and what is required of the respondent.

Article 40, paragraph 2, of the Rules deals with the appointment of the agent when the case is instituted by means of the unilateral submission of an application. It provides:
