The procedure of Article 88, which places the emphasis on the joint act of the parties, is available regardless of the manner in which the proceedings were instituted. It is not necessary that the parties inform the Court of the terms of the settlement: their action, which may be joint or separate, in informing the Court of the fact of the settlement is sufficient.
