On the one hand, a generic term for unlawful behaviour in general and for illegality and fault in respect of the  lex Aquilia , and on the other hand the term for an offence including wilful physical injury and insult to honour. The Twelve Tables provided retaliation in kind ( talio ) for serious cases of iniuria. This was not applicable in the case of agreement over damages ( pactum ).
